UNDER NO CIRCUMSTANCES WILL Paris Paradis OR ITS AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION, TO THE COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOST PROFITS, OR LOST DATA) ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICES, WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR OTHERWISE, (EVEN IF CHEAPFAREMART OR ITS AGENTS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). THIS LIMITATION OF LIABILITY WILL APPLY WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF OR RELIANCE ON THE SERVICES, FROM INABILITY TO USE THE SERVICES, OR FROM THE INTERRUPTION, SUSPENSION, MALFUNCTION, OR TERMINATION OF THE SERVICES. THIS LIMITATION WILL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE SERVICES OR RECEIVED THROUGH ANY LINKS DISPLAYED THROUGH THE SERVICES, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED ON THE SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED IN THE SERVICES. SUCH LIMITATION WILL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW AND EVEN IF CHEAPFAREMART OR ITS AGENTS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow the exclusion or limitation of liability for incidental damages, consequential damages, or intentional conduct, so the above limitations and exclusions may not apply to you. In such jurisdictions, the foregoing limitations shall apply to the fullest extent permitted by law. IN NO EVENT SHALL PARIS PARADIS’S LIABILITY TO YOU EXCEED $100 IN TOTAL FOR ANY CLAIM OR CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICES, WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR OTHERWISE, (EVEN IF PARIS PARADIS OR ITS AGENTS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES).

 

11. INDEMNIFICATION

You agree to defend and indemnify Paris Paradis, its subsidiaries, affiliates, and associated companies and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; or (c) your use of the Services.

 

 

12. PAYMENT

12.1. Payment Card (Credit/Debit) Details

You agree that the payment card details provided for travel reservation is correct and accurate and that you shall not use a credit card, which is not lawfully owned by yourself or the use of which is not authorized by the lawful owner thereof. You further agree to use a valid card.

 

12.2. Agency fee

Paris Paradis levies an agency fee per passenger in case of flight booking or per guest/individual in case of hotel reservation which is in addition to the booking fee charged by the selected travel supplier.

 

12.3. Payment fees

Some form of payments may be subject to a surcharge. This is specified at the time of booking and is usually based on a percentage of the booking cost.

 

12.4. Payment Currency

Prices are displayed and charged as per the currency you select. If the selected currency is other than that of the card issuer, foreign currency charges or additional bank charges my be applicable in accordance with the card issuer’s terms. Example, if you make a booking selecting AED currency but using a bank card issued with OTHER currency, then there would be Foreign Exchange (FX) rates involved to convert the currency from AED to OTHERS. Some countries charge an additional FX or surcharges for cross border transactions. Your bank can provide the up-to-date information on FX or additional FX charges. Paris Paradis accepts no liability or responsibilities for bank surcharges.

 

12.5. Refunds

Cancelled bookings are not refundable unless cancelation request has been sent in writing to Paris Paradis 7 days before ethe booked date. Any such refunds for a cancelled booking as stated before are processed after deducting the cancellation charges imposed by the travel supplier along with Paris Paradis fees, cashback, or discounts, if any. We refund the amount into the original account that was used for booking. The process takes 4 working days but it may take 15-20 days for the amount to reflect in your account depending upon your bank. Due to specific regulations, the time to receive your refund may be over 30 days.

Similar to the FX fees rules during the purchase or booking, the same may apply during the refund. Your bank may deduct the Foreign Exchange (FX) charges and surcharges as applicable.

 

13. Owner’s Rights

We do hereby reserve the right to:

a- modify or withdraw, temporarily or permanently, the Website (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or

b- change these Conditions from time to time, and your continued use of the Website (or any part of) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.

c- We will use our reasonable endeavours to maintain the Website. The Website is subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of the Website or because of a failure, suspension or withdrawal of all or part of the Website due to circumstances beyond our control.

d- We have the right, but not the obligation, to monitor any activity and content associated with the Website. We may investigate any reported violation of these Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from the Website).

Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Dubai – United Arab Emirates.
